These Terms & Conditions (“Terms”) form a legally binding agreement between you (“you” or “User”) and WooshAuto Internet Private Limited (“Kulfi,” “we,” “us,” or “our”). By downloading, installing, registering for, accessing, or using the Kulfi mobile application, website, or any related services (together, the “Services”), you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility & Account Creation

  1. You must be at least 18 years old and legally competent to enter a binding contract.
  2. You agree to provide true, accurate, and complete information during sign‑up and to keep it up to date.
  3. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

2. Communications Consent

Transactional & Promotional Messages

  • By creating an account, you consent to receive verification codes, transactional alerts, product updates, and promotional messages via SMS, push notifications, email, or in‑app messages.
  • Message and data rates may apply as charged by your carrier.
  • Message frequency depends on your activity (e.g., one‑time OTPs, daily streak reminders, feature updates). The maximum expected frequency is 10 messages per week.
  • Opt‑out information:
    • SMS: Reply STOP to cancel or HELP for assistance.
    • Push & email: Adjust preferences in Settings › Notifications.

3. Costs & Paid Features

  1. Downloading the app is free. Certain in‑app purchases (e.g., premium packs, freeze tokens) are optional. Prices are displayed before purchase and are in Indian Rupees unless stated otherwise.
  2. All payments are processed by authorized payment partners. You agree to their terms and to pay any taxes or fees applicable.
  3. Purchases are non‑refundable except where required by law.

4. User Content & Conduct

  1. You may post text, images, or other content only if you have the necessary rights and if the content is lawful, respectful, and non‑harmful.
  2. Prohibited conduct includes harassment, hate speech, nudity or explicit sexual content, impersonation, fraud, or violation of another's rights.
  3. You grant Kulfi a worldwide, royalty‑free licence to host, display, and distribute your content solely to operate the Services.

5. Intellectual Property

  1. All trademarks, logos, code, artwork, and other intellectual property in the Services belong to Kulfi or its licensors.
  2. You receive a limited, non‑exclusive, non‑transferable licence to use the Services for personal, non‑commercial purposes. Reverse engineering or scraping is prohibited.

6. Privacy & Data Protection

Kulfi processes personal data in accordance with India's Digital Personal Data Protection Act 2023, the Information Technology Act 2000, and, where applicable, the GDPR and CCPA. See our Privacy Policy for details on collection, use, retention, and your rights.

7. Third‑Party Links & Integrations

Our Services may include links or integrations with third‑party sites (e.g., payment gateways, social media). Kulfi is not responsible for the content, practices, or policies of these third parties.

8. Termination

  1. You may delete your account at any time under Settings › Personal Details.
  2. Kulfi may suspend or terminate access without notice if you breach these Terms or if required by law. Clauses that by nature survive termination (e.g., intellectual‑property licence, disclaimers, limitation of liability) continue to apply.

9. Disclaimers

  1. The Services are provided “as is” and “as available.” We make no warranties—express or implied—about accuracy, reliability, or fitness for a particular purpose.
  2. Kulfi does not provide medical, psychological, or legal advice. Always seek professional guidance where appropriate.

10. Limitation of Liability

To the fullest extent permitted by law, Kulfi is not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising out of your use or inability to use the Services.

11. Indemnification

You agree to indemnify and hold harmless Kulfi and its directors, officers, employees, and agents from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

12. Governing Law & Dispute Resolution

  1. These Terms are governed by the laws of India, without regard to conflict‑of‑laws principles.
  2. Any dispute that cannot be resolved amicably within 30 days shall be submitted to binding arbitration in New Delhi under the Arbitration and Conciliation Act 1996. The arbitration proceedings shall be in English.
  3. Subject to the preceding clause, courts in New Delhi have exclusive jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via the app or email at least 7 days before taking effect. Continued use after the effective date constitutes acceptance of the revised Terms.
